東京都港区虎ノ門に本拠を置く「弁護士法人横山法律事務所」が、1月10日付で東京地方裁判所から破産手続きの開始決定を受けたことが明らかになった。2020年に設立された同事務所は、国際ロマンス詐欺やFX・仮想通貨詐欺の被害救済を専門とし、インターネット広告を駆使して積極的に集客を行っていた。しかし、依頼者から受け取った着手金の不正流用や業務運営のずさんさが問題視され、2024年8月に第一東京弁護士会より破産申し立てを受ける事態となった。

横山法律事務所は設立当初から被害者救済を謳い、インターネット広告を通じて急成長。2022年5月時点で受任件数は1000件を超えていたとされる。しかし、依頼者から受領した着手金を適切な業務に充てることなく、正当な理由もないまま他の関係者へ分配していたことが発覚。さらに、受任時の説明義務違反や事件処理に関する報告義務の懈怠など、弁護士業務としてあるまじき行為が相次いで確認された。
こうした問題行為に対し、2024年5月には第一東京弁護士会が懲戒手続を開始。その後の調査で、依頼者への報告を怠るのみならず、弁護士職務基本規程に違反する広告の掲載も判明し、8月にはついに同会が破産を申し立てるに至った。

関係者によると、同事務所の資金繰りは2023年時点で悪化していたとみられる。弁護士会の調査によれば、依頼者からの「進捗報告がない」「返金請求に応じない」といった苦情が急増し、被害相談が相次いでいたという。
法曹界関係者は「弁護士が依頼者の資金を不正に扱うのは極めて悪質な行為だ。今回の事案は、単なる経営不振ではなく、弁護士倫理の欠如が招いた破綻といえる」と指摘する。
同事務所の破産により、多くの依頼者が未解決案件を抱えたままとなり、債権者への影響も懸念される。今後、破産手続きの中で資産の精査が進められる見通しだが、依頼者への返金がどの程度実現されるかは不透明な状況だ。
